What Type of Information Do We Collect?

Via the Site, SMART Prep collects: (i) personally identifiable information, and (ii) technical and other information.

Children — In compliance with the Children’s Online Privacy Protection Act, 15 U.S.C. §§501-06 and 16 C.F.R. §§ 312.1-312.12, Smart Prep does not permit children under 13 years of age to become users without their parent or guardian’s express consent and approval. By using our Site, you represent (i) you are not under 13 years of age or (ii) if you are under the age of 13, we must have permission from your parent or legal guardian before we collect or use any Personal Information of you on the site. For parents or legal guardian of children under the age of 13, you are welcome to e-mail us to review any personal information we have collected about your child. You may request that we delete this information or specify that we collect no more of your child’s information. We will need to verify the identity of anyone requesting information about a child under the age of 13 to ensure that the person is in fact the child’s parent or legal guardian. It is possible that by fraud or deception we may receive information given to us or pertaining to children under 13. If we are notified of this, we will immediately obtain parental consent after we verify the information or delete the information from our servers.

General Site Visitors — When you browse the general, non-password protected portions of the Site, you do so anonymously; no personally identifiable information is collected.

Contacting Us — The Site permits you to contact us via our Contact Us Form. Whenever you send an e-mail through the Contact Us Form on the Site, you will be providing us with your name, e-mail address, and any information you choose to include in the text of your message.

While you are browsing the Site, we automatically log your IP address (a number assigned to your computer when you use the Internet) and your activity while using the Site. Additionally, in order to personalize and enhance your experience on the Site, we may also collect information through ‘cookies’. We use cookies to help diagnose problems with our servers and to administer the Site. These cookies may stay on your browser into the future until they expire or you delete them. We also use technology to remember you the next time you log in. You change your browser setup so that it does not accept cookies. Our Use of Information

We collect, retain, and use the personally identifiable information we collect via the Site for legitimate business purposes only, including without limitation the following: to qualify you as a subscriber of Smart Prep with access to the password protected portions of the Site; to provide the Site’s services to subscribers and to otherwise operate and improve the Site; responding to an inquiry from you or addressing a request submitted by you (including contacting you directly to request additional information to process your inquiry or request); contacting you to provide information regarding Smart Prep and/or our affiliates; providing you information regarding offers from third parties with respect to their products or services we believe may be of interest to you; to correspond with you regarding the Site or our services; to inform you of developments in our company or with our services that we believe may be of interest; to monitor Site visitor traffic patterns and Site usage; to comply with applicable laws, regulations and rules, and requests of relevant regulatory and law enforcement and/or other governmental agencies; to enforce our Terms of Use; and/or to protect the rights, property, or safety of Smart Prep, our users, and/or others.

Use of third party personal information
Access to Your Account

You may also choose to allow other individuals to monitor your account, such as parents and guardians. If you choose to use this feature, we will ask you to provide us with that person's name and e-mail address. We will send him or her one or more e-mails inviting him or her to visit Smart Prep to register and monitor your progress. By inviting such individuals to monitor your progress, you are granting permission to Smart Prep to share the details of your profile with them. This information includes personally identifiable information, including your name, address, phone number, e-mail address, grades, schools that are interested in you and other information you have provided to us.

Changes to the Smart Prep Privacy Policy

We reserve the right to change, modify or amend this policy at any time. You may inquire of us (either by the phone number or Contact Us) at any time to see if changes or modifications have been made. Your child’s continued enrollment at Smart Prep implies your consent to our privacy policy as modified.

Consequences of not providing information / Right to opt out

1. You may choose not to provide us with your personally identifiable information. However, choosing not to provide certain requested personally identifiable information may prevent you from accessing and taking advantage of certain services offered by Smart Prep.
2. If you are a subscriber of Smart Prep, you may opt out of receiving communications from us and our affiliates. In addition, if you no longer wish to receive our newsletter, you can opt-out of receiving any future newsletters.
3. If you do not wish to continue receiving text messages or e-mail advertising service from us, you may direct us to stop marketing to you.

Business transfer

Smart Prep may, in the future, sell or otherwise transfer some or all of its assets to a third party. Your personally identifiable information and/or technical information we obtain from you via the Site may be disclosed to any potential or actual third party purchasers of such assets and/or may be among those assets transferred.

Smart Prep reserves the right to modify this privacy notice at any time. We encourage visitors to frequently check this page for any changes to this Privacy Notice. If we make changes, we will post an updated effective date below. Your continued use of this site after any change in this Privacy Policy will constitute your acceptance of such change.

California Privacy Policy

Beginning on January 1, 2005, California's "Shine the Light" law provides California residents with the right to receive disclosures about any sharing of their personal information with other companies.
If you are a California resident and you provided your personal information to Smart Prep Test Prep and Admissions ("Smart Prep"), then, once each calendar year, you may submit a written request for information about the information we shared, if any, with other companies for their use in direct marketing. To submit your written request, please send an E-mail to help@smarteducations.com with "Request for California Privacy" in the subject line.
Within 30 days of receiving your request, we will send you a list of the categories of personal information disclosed to third parties for third-party direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of these third parties.
We reserve our right not to respond to requests sent more than once in a calendar year, or requests submitted to an address other than the one posted in this notice.
Please note that the California "Shine the Light" law does not cover all information sharing. Our disclosure only includes information covered by the law.
